Notams Redefine U.S. Flight Requirements

In conjunction with the Transportation Security Administration, Department of Homeland Security, Department of Defense and Customs and Border Protection, and as the result of new regulations, the FAA released on October 2 two new Flight Data Center Special Notice Notices to Airmen–FDC 8/2136 and 8/2189. These Notams, which concern “flights that wish to operate to or from or within or transit territorial airspace of the United States,” replace FDC Notam 6/7435 and contain this warning: “Any flight operations within 100 nm of the U.S. border that requires an ATC-assigned beacon code MUST continuously squawk the ATC assigned discrete beacon code or will be considered to be in violation of all applicable regulations and be subject to interception by U.S. military aircraft and/or be denied entry or re-entry into the U.S.” According to Kerry Fleming of the FAA’s System Operations Support Center, the purpose of the new Notams is “to clarify requirements that were in effect but not spelled out well, and to close some loopholes that were being exploited.” The Special Notices are available on www.faa.gov.
