The payment dispute between Eclipse Aviation and Eclipse 500 empennage assembly supplier Hampson Aerospace seems to be resolved for now, according to a recent court filing. On November 13, Hampson filed a lawsuit against Eclipse Aviation in the New Mexico Second District Court for failing to pay “in accordance with the schedule and under the terms set out” in a contract. As per the agreement, Eclipse must purchase a minimum number of shipsets from Hampson or pay for that number each year. In the most recent filings, Eclipse rescinded its original claim that the contract “was procured by fraud” and said it will now “fully perform” under terms of the agreement with Hampson. According to court documents, Eclipse has sent Hampson a $243,556 payment that was due last month and will now make monthly payments of $337,778 until early 2009. Hampson’s attorneys asked the court to place these funds in escrow until the case is fully resolved. The tail supplier also asked for a partial summary judgment stating that the agreement is valid and enforceable. Eclipse had no official comment at press time.
