The minimum percentage rate for substance-abuse testing for next year will remain at 25 percent of covered aviation employees for random drug testing and 10 percent for random alcohol testing. The rates will remain unchanged because historical data indicates that the positive rate for drug tests over the last several years has been less than 1 percent.

The FAA determined that the minimum percentage rate for substance-abuse testing this year will remain at 25 percent of covered aviation employees for random drug testing and 10 percent for random alcohol testing. The rates will remain the same because data indicates that the positive rate for drug tests over the last two years was less than 1 percent and the positive rate for alcohol tests in the past two years was less than 0.5 percent.

The FAA has determined that the minimum random drug and alcohol testing percentage rates for next year will remain at 25 percent of safety-sensitive employees for random drug testing and 10 percent of safety-sensitive employees for random alcohol testing. These rates have remained unchanged since 1998, when they were first set.

The FAA yesterday adopted a 2004 notice of proposed rulemaking amending airman medical standards so that a refusal to submit to a required drug or alcohol test carries the same penalty as failure of a test–revocation or disqualification from holding an airman medical certificate. The same penalty awaits a pilot with an alcohol test result of 0.04 or greater.

The FAA recently hosted representatives from key industry organizations, including the Aeronautical Repair Station Association (ARSA), to discuss aspects of new drug and alcohol testing rules pertaining to maintenance contractors and subcontractors for Part 121 and 135 operators (FAR 135.251 and 135.253).

FAA officials at a meeting last month told representatives from key industry organizations, including the Aeronautical Repair Station Association (ARSA), that guidance for a new drug testing rule would be released in “the coming weeks.” The new drug and alcohol testing rules, with a delayed effective date of October 10, pertain to maintenance contractors and subcontractors for Part 121 and 135 operators (FAR 135.251 and 135.253).
