Brazil's aircraft investigation board, Cenipa, won't release its report on the Embraer Legacy 600/Gol Airlines Boeing 737-800 midair until early next month, but many of the report's details have already been leaked to São Paulo-based daily newspaper Folha de São Paulo. All 154 aboard the Gol airliner were killed when the two aircraft collided at FL370 over Brazil's Amazon jungle, but the damaged Legacy landed safely.

A Brazilian judge asked ExcelAire pilots Joseph Lepore and Jan Paladino to return to Brazil to testify at the August 27 beginning of the trial on criminal charges, but according to Joel Weiss, their U.S. attorney, the two pilots did not return to Brazil to testify. Both pilots were held for 71 days in Brazil after the midair between the Embraer Legacy 600 they were flying and a Gol Airlines Boeing 737 in Brazil last September.

A Brazilian judge has asked ExcelAire pilots Joseph Lepore and Jan Paladino to return to Brazil to testify at the August 27 beginning of the trial on criminal charges. Four air traffic controllers were also indicted, and their testimony is due on August 28.

American pilots Joseph Lepore and Jan Paladino were indicted last month for their alleged part in the collision of their Embraer Legacy with a Gol Airlines Boeing 737 over the Amazon jungle last September in which all aboard the airliner died. The judge in the case agreed to proceed with the prosecutor’s suggested indictment, officially charging the pilots with unintentional endangerment of an aircraft through negligence.
