Malaysia Airlines Flight MH17 broke apart above eastern Ukraine on July 17 as the result of structural damage caused by penetration of the Boeing 777-200 by a “large number of high-energy objects,” according to a preliminary Dutch Safety Board report issued Tuesday. Furthermore, the board found no evidence of a technical fault or that any crew action caused the crash.

Yesterday, Brazil’s Regional Federal Tribunal shortened the sentences of U.S. pilots Joe Lepore and Jan Paladino, who survived the midair of their Embraer Legacy 600 with a Gol Airlines Boeing 737 over the Amazon in September 2006. In May last year they were acquitted in absentia on all but one of six charges.

During the appeals hearing, the Legacy pilots’ sentences were reduced from four years and four months to three years, one month and 10 days. The judges also struck down the suspension of Lepore’s and Paladino’s pilot certificates.

On Monday, a Brazilian court will hear the appeal of U.S. pilots Joe Lepore and Jan Paladino, who survived the midair of their Embraer Legacy 600 with a Gol Airlines Boeing 737 over the Amazon in September 2006. After being detained in Brazil for more than two months after the accident, they returned home and, in May 2011, were acquitted in absentia on all but one of six charges.

An appeals court in Brazil found American journalist Joe Sharkey guilty yesterday of defamation for his reporting and commentary following the 2006 accident in which 154 died when a Brazilian airliner and a Legacy 600 business jet collided at 37,000 feet over the central Amazon. Sharkey, on assignment at the time for Business Jet Traveler (an AIN Publications magazine for users of business aviation) was one of seven on the Legacy 600 who survived the collision when the damaged business jet managed an emergency landing at a remote military airstrip in the jungle.

American pilots Joseph Lepore and Jan Paul Paladino, whose Legacy 600 was involved in a collision with a Gol Airlines Boeing 737-800 over the Amazon jungle in September 2006, were found guilty by Brazilian federal judge Murilo Mendes last month of failing to verify the functioning of the transponder for more than an hour.
