The investigation into why an Embraer Legacy and Gol Airlines Boeing 737 collided over the Amazon jungle last September 29 isn’t expected to conclude for several months, but that hasn’t stopped Brazil’s Federal Police from recommending criminal prosecutions for ExcelAire pilots Joseph Lepore and Jan Paladino.
A Brazilian public prosecutor has recommended that a federal judge indict four air traffic controllers and the two American pilots involved in the midair collision between an Embraer Legacy operated by ExcelAire and a Boeing 737 operated by Gol over the Amazon jungle last September. The prosecutor is requesting that one of the controllers, Jomarcelo Fernandes dos Santos, be charged with intentional manslaughter.
Cockpit voice recordings from the Embraer Legacy that collided with the Gol Airlines 737 over the Amazon last September indicate that the two business-jet pilots were very much aware of their position and altitude, despite earlier reports to the contrary. The transcript shows the Legacy crew checked in at their assigned altitude of FL370 at 1850Z.
NBAA, the Flight Safety Foundation (FSF) and the International Federation of Air Line Pilots’ Associations (IFALPA) heavily criticized a decision by Brazilian police investigators to recommend criminal prosecutions of ExcelAire pilots Joseph Lepore and Jan Paladino in connection with last September’s midair between a Gol Airlines Boeing 737 and Embraer Legacy over the Amazon jungle.
Brazil’s Federal Police has concluded that ExcelAire Legacy pilots Joseph Lepore and Jan Paladino were responsible for the September collision with a Boeing 737-800 operated by Gol Linhas Aereas. The pilots are accused of negligence in the collision, which resulted in the death of all 154 people aboard the Boeing.
Following a runway overrun at Colorado’s Garfield County Regional Airport (RIL) on March 23, the operator of the Falcon 900 that departed Runway 26 after landing is working with investigators and Dassault Falcon Jet to figure out what happened. The Falcon 900 was operated by Xojet, a charter/management company headquartered in San Carlos, Calif., and was on a repositioning flight from Scottsdale, Ariz.
While the investigation into the causes of the September midair between an Embraer Legacy operated by Long Island-based ExcelAire and a Boeing 737 operated by Brazilian low-cost airline Gol is still under way, Brazil’s ATC system is already feeling the repercussions of the investigation, which has exposed weaknesses in the system.
On April 1, the NTSB celebrated its 40th anniversary. On that date in 1967, the Bureau of Safety was removed from the Civil Aeronautics Board and became the new accident investigation agency. Each year, the agency’s staff of fewer than 400 employees investigates more than 2,000 accidents and incidents.
Implementing safety management systems (SMS) and developing operator decision-making skills are imperative to improving the accident record for helicopters. That was the message more than 100 helicopter pilots, crewmembers and industry managers heard at the third annual Helicopter Safety Forum, co-sponsored by FlightSafety International and Rotor & Wing magazine, held this year in Dallas-Fort Worth.
